Terms of Service

By creating an account, accessing, or using ORME AI (the “Service”), operated by Welbuilt AI Solutions Private Limited (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you (whether an individual or an entity) and Welbuilt AI Solutions Private Limited. You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

ORME AI is a software-as-a-service (SaaS) platform that provides Instagram automation tools powered by artificial intelligence. The Service includes, but is not limited to:

• Autonomous AI agents that classify comment intent and generate contextual replies
• Multi-channel automation for Instagram comments, direct messages, stories, and live streams
• Visual flow builder for designing complex multi-step workflows
• Subscriber CRM for tracking interactions and managing audience segments
• Knowledge base management for AI training and response accuracy
• Shadow mode and sandbox environments for testing AI behavior
• Analytics and performance monitoring dashboards

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service without liability.

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

• Provide truthful and accurate registration information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities conducted through your account
• Not share your account credentials with unauthorized third parties

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

ORME AI integrates with Instagram through the Meta Graph API. By connecting your Instagram account to our Service, you acknowledge and agree that:

• You must comply with Meta's Platform Terms, Community Guidelines, and all applicable Instagram policies
• You authorize ORME AI to access and interact with your Instagram account data as permitted by the Meta API
• You are solely responsible for the content posted through the Service on your behalf, including AI-generated replies
• Meta may revoke API access at any time, which may affect Service functionality
• We do not guarantee uninterrupted access to Instagram features, as they depend on third-party API availability

You must not use the Service to violate Instagram's terms of use, engage in spam, manipulate engagement metrics, or conduct any activity that could result in the suspension of your Instagram account.

The Service, including its original content, features, functionality, software, design, and documentation, is and shall remain the exclusive property of Welbuilt AI Solutions Private Limited and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of all content you submit to the Service, including knowledge base documents, brand voice configurations, and custom automation workflows. However, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content solely for the purpose of providing and improving the Service.

AI-generated responses produced by the Service on your behalf are considered your content once posted. You are responsible for reviewing and approving such content before it is published.

ORME AI operates on a subscription-based pricing model. By selecting a paid plan, you agree to pay all applicable fees as described on our pricing page.

• Subscriptions are billed on a recurring monthly or annual basis, depending on your chosen billing cycle
• All fees are quoted in USD and are exclusive of applicable taxes unless stated otherwise
• You authorize us to charge your designated payment method for recurring subscription fees
• Failure to pay may result in suspension or termination of your access to paid features
• Plan upgrades take effect immediately with prorated charges; downgrades take effect at the next billing cycle

We reserve the right to modify pricing with at least 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Send spam, unsolicited messages, or engage in deceptive marketing practices
• Harass, threaten, defame, or discriminate against any individual or group
• Distribute malware, viruses, or any harmful software through the Service
• Attempt to gain unauthorized access to other users' accounts or our systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to artificially inflate engagement metrics on Instagram
• Scrape, mine, or extract data from the Service beyond its intended use
• Resell, sublicense, or redistribute the Service without written authorization
• Use the Service to promote illegal products, services, or activities

Violation of these prohibitions may result in immediate account termination without refund.

To the maximum extent permitted by applicable law, Welbuilt AI Solutions Private Limited, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:

• Your use of or inability to use the Service
• Any unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on the Service
• Actions taken by Instagram or Meta that affect Service functionality
• AI-generated content that may be inaccurate, inappropriate, or cause reputational harm

In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim. The Service is provided on an “as is” and “as available” basis without warranties of any kind.

You may terminate your account at any time through your dashboard settings or by contacting our support team. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• You remain responsible for any outstanding fees accrued before termination
• We will retain your data for 30 days, after which it will be permanently deleted
• You may request an export of your data during the 30-day retention period

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you via email or through a prominent notice on our Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and close your account.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Tiruvannamalai, Tamil Nadu, India.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
